Terms of Service

Rules for using DevHelm.

1. Service Provider

DevHelm is operated by Vladyslav Mokrousov, sole proprietor (jednoosobowa działalność gospodarcza) registered in Poland, NIP: 8522710570. Throughout these Terms, "DevHelm", "we", "our", and "us" refer to this entity.

2. Acceptance of Terms

By accessing or using DevHelm ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

3. Description of Service

DevHelm provides uptime monitoring, dependency intelligence, status pages, and related tools for developers and engineering teams. The Service is provided "as is" with the uptime guarantees specified in your plan's Service Level Agreement (SLA).

4. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

5. Acceptable Use

You agree not to:

  • Use the Service to monitor endpoints you do not own or have authorization to monitor
  • Attempt to overwhelm or abuse the monitoring infrastructure
  • Use the Service for any illegal purpose
  • Resell or redistribute the Service without written permission
  • Interfere with other users' use of the Service

6. Plans and Payment

Paid plans are billed monthly or annually as selected. Prices are subject to change with 30 days' notice. All payments are processed securely by our Merchant of Record, Paddle.com Market Ltd, who handles billing, sales tax, and invoicing on our behalf.

Free tier usage is subject to the limits described on our pricing page and may be adjusted over time.

7. Service Level Agreement

Paid plans include a 99.95% platform uptime SLA. SLA credits are calculated monthly and applied to your next billing cycle. The Free tier operates on a best-effort basis with no SLA guarantee.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of all data you provide to the Service. We use your data solely to provide and improve the monitoring service.

9. Intellectual Property

The Service, including its design, code, and documentation, is the property of DevHelm. You are granted a limited, non-exclusive license to use the Service in accordance with these Terms.

10. Termination

Either party may terminate the agreement at any time. You can cancel your subscription from the dashboard or by contacting support. Upon termination, your access to paid features will cease at the end of your current billing period. We will retain your data for 30 days following termination, after which it will be deleted.

We reserve the right to suspend or terminate accounts that violate these Terms.

11. Limitation of Liability

To the maximum extent permitted by law, DevHelm's liability is limited to the amount you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will provide notice of significant changes via email.

13. Governing Law

These Terms are governed by the laws of Poland. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts in Poland. For consumers residing in the EU, mandatory consumer protection laws of their country of residence shall apply where they provide greater protection.
